What a fair clause looks like, point by point

Sample wording you can ask your agency for. Adapt it with a lawyer; it is not a template contract.

  1. Commission base: net or gross. “Commission is calculated on net earnings: the amount the platform pays out to the creator after its own fee.”
  2. Commission per service. “Full management (chatting, marketing, content planning): X% of net. Chatting only: Y% of net. No other fees.” Each service has its own written rate; full management within the published range (20%–60%).
  3. Minimum term. “There is no minimum term. Either side can end the agreement with written notice.”
  4. Notice period. “Either side can end the agreement with 30 days’ written notice (email is enough).”
  5. Commission after you leave. “No commission is owed on earnings after the end date. Commission for the final month is settled within 14 days.”
  6. Login and 2FA. “The creator keeps sole control of login, email and 2FA. The team works through access the creator can revoke at any time.”
  7. Where payouts go. “Platform payouts go to the creator’s own bank account. The agency invoices its commission monthly.”
  8. Content after you leave. “All content remains the creator’s property. At the end, the agency deletes its copies within 14 days and confirms it in writing.”
  9. Penalties and buyout fees. “There is no exit fee, penalty or holdback. Earnings up to the end date are settled normally.”
  10. Exclusivity and non-compete. “During the term, the agency is the only agency managing this account. There are no restrictions after the end date.”
  11. Who writes your chats, and AI. “Messages are written by trained people on the agency’s team. AI is not used to write to fans (or: AI use is limited to X and disclosed).”
  12. Reporting. “The creator receives a written report every week: revenue by source, message sales, actions taken and next steps.”
  13. Social media accounts. “All social media accounts are registered to the creator’s email and phone number and remain the creator’s. Team access is removed at the end.”
  14. Leak protection. “Leak takedowns are included in the commission. Typical takedown time and a monthly takedown report are part of the service.”

FAQ

What does a fair OnlyFans agency contract look like?

Commission on net at a written rate for each service, no minimum term or a short trial, notice of 30 days or less, no exit fee, no commission after the end date, and login, 2FA, payouts, content and social accounts in your name. Weekly written reports and a clear statement on who writes your chats complete it.

Is OnlyFans agency commission usually on net or gross?

Net. Of the 11 agencies (of 29 reviewed) that publish a base, 10 use net and 1 uses gross. 30% of gross equals 37.5% of net, because the platform keeps 20% first.

What commission is normal for an OnlyFans agency?

Among the 14 agencies with a published full-management rate, the median range is 35% to 55%; the lowest figure is 20% and the highest 60%. Published chatting-only prices run from 15% to 30%.

Can an agency take commission after I leave?

Only if your contract says so. 8 of 29 agencies rule it out in writing, 21 say nothing, and 0 publish one with length and base.

Should my agency have my password or 2FA codes?

No. Platforms allow team access the creator can revoke. 12 of 29 agencies state in writing that the creator keeps sole control of login and 2FA.

Is this legal advice? Do you store my answers?

No and no. The check is a checklist based on what agencies publish, not legal advice; for a binding assessment ask a lawyer in your country. Your answers are processed in your browser only. Nothing is uploaded, sent or stored.

My result is red. What should I do?

Do not sign a renewal yet. Ask the agency to change the red clauses in writing. If you leave, give notice in writing, move the account email, 2FA and payout details to yourself, and remove team access on the platform and on social media. The exit report shows what fair exit terms look like.

How is the result calculated?

Each answer is rated green, yellow or red against what the reviewed agencies publish. One red answer makes the overall result red; two or more yellow answers make it yellow; otherwise it is green.
